Teresa Rosen Peacocke is American, and obtained Bachelors and Masters degrees in and taught Philosophy in the US before coming to the English Bar. She later obtained an LLM degree in Law from New York University Law School and is a practising attorney in Chambers’ New York office.

Practice

Teresa’s practice is predominantly litigation in the US and UK, and covers a broad range in the Chancery and commercial fields.

She is often involved in professional negligence cases (especially those involving the doctrine of White v Jones, in which she was junior counsel), and cases involving commercial, trust and probate litigation in both UK and US courts.

A significant proportion of her work involves coordinating litigation in both London and New York (and other US courts), in company, commercial, professional negligence, trust and probate cases, including obtaining simultaneous pre-emptive remedies in different jurisdictions, pursuing expert and deposition evidence and discovery in US courts in support of UK litigation, and enforcing foreign interlocutory and final judgments in US and UK courts.

In recent years she has appeared in cases in New York, Guernsey and Portland, Oregon.

Teresa also undertakes commercial drafting and advisory work in commercial, trust and capital taxation spheres.

Notable recent cases

  • Teresa appeared in Royal Bank of Scotland plc v Etridge [2002] 2 AC 773 in the House of Lords, and more recently successfully defended solicitors and a major UK clearing bank in the Court of Appeal. She continues to act for the bank in enforcement of security documents.
  • She was engaged as an expert on English law and procedure in New York litigation, and coordinated litigation in London with simultaneous actions in Guernsey, Delaware, and Portland, Oregon.
  • She currently represents clients involved in contentious and non-contentious legal business arising from the terrorist attack in New York on September 11, 2001 and the Tsunami disaster in Thailand on December 26, 2004.
